NRI Inheritance: How to Transfer and Sell Inherited Land in Bina, Madhya Pradesh
Many NRIs inherit ancestral land in the Bina-Sagar region but do not know how to legally claim, mutate, or sell it. This guide explains the succession process, mutation, and FEMA rules for inherited property.
Inherited Land Is Different from Purchased Land — and Easier for NRIs
Unlike purchased property, inherited or gifted agricultural land CAN be held by an NRI — FEMA prohibits NRIs from buying agricultural land, but does not require them to sell agricultural land they inherit. So if your parents or grandparents left you ancestral farmland in or around Bina, you can legally own it, mutate it in your name, and either retain it or sell it.
The inheritance route also has a repatriation advantage: an NRI can repatriate the sale proceeds of inherited property up to USD 1 million per financial year, the same limit as purchased property, provided the sale is through banking channels and capital gains tax is paid.
The process has three stages: (1) establish your claim through a legal document, (2) mutate the land records to your name, and (3) sell or hold as you choose. Each stage has specific paperwork that an NRI can complete largely from abroad with a Power of Attorney.
Stage 1 — Establishing Your Claim: Will, Succession Certificate, or Legal Heir
If the deceased left a registered Will naming you as the heir to the Bina land, the process is straightforward: the Will is the primary document, supported by the death certificate and your identity proof. You (or your POA holder) submit these to the tehsildar for mutation.
If there is no Will (intestate succession), the land passes to legal heirs as per the Hindu Succession Act (or the relevant personal law). You will need a Legal Heir Certificate (issued by the tehsildar) or, for larger or disputed estates, a Succession Certificate from the civil court. The Legal Heir Certificate lists all Class-I heirs (spouse, sons, daughters) and their shares.
For an NRI, the practical step is to authorise a relative or advocate in India (via a Special POA attested at the Indian Embassy abroad) to apply for the Legal Heir Certificate, submit the death certificate, and initiate mutation. Bina Estates coordinates this with Sagar-district advocates who handle NRI succession cases routinely.
Stage 2 — Mutation: Getting the Land Records in Your Name
Mutation (entry of your name in the revenue records, or Dakhil Kharij) is the legal act that makes you the recorded owner. Without mutation, you cannot sell the land — the buyer's advocate will not clear the title.
The mutation process in Sagar district:
- Apply to the Tehsildar (Bina tehsil, or the relevant tehsil where the land is located) with the Will/Legal Heir Certificate, death certificate, your ID, and the Khasra details of the inherited land.
- The Patwari inspects and verifies, then forwards the file.
- The Tehsildar orders mutation; the entry is made in the Khasra/Khatian on the MP Bhulekh portal.
- You receive a mutation order copy — this is your proof of recorded ownership.
Timeline: 30–90 days if uncontested; longer if a relative disputes the share. For NRIs, the POA holder follows up with the Patwari and collects the order. Bina Estates offers a mutation coordination service for inherited land — contact us at +91 99868 88311.
Stage 3 — Sell, Develop, or Hold: Your Options After Mutation
Once the land is mutated in your name, you have three paths:
Sell it: If the inherited land is agricultural and you want to sell, you can sell to an Indian resident (another farmer, a developer, or an industrial buyer). If the buyer wants it for non-agricultural use, the buyer (or you) must obtain a diversion order first. Bina Estates can help identify buyers for inherited Bina-region land, especially if it is near the refinery corridor or highway where demand is strong.
Develop it: If the land is well-located (e.g., near Refinery Road or NH-86), you can divert it to commercial/residential use and either build or sell the diverted plot at a premium. Diversion typically raises land value 2–4x.
Hold it: If the land is in the refinery growth path, holding 3–5 years may yield significant appreciation as the BPCL expansion matures. You pay nominal annual khajna (property tax) and can manage it through a POA or Bina Estates' property management service.
Inherited land is often the first touchpoint an NRI has with the Bina real estate market. Many of our NRI clients started by sorting out an inherited plot — and then, once they saw the appreciation, became active buyers of additional refinery-zone land. Contact Bina Estates to begin the mutation or sale of your inherited property.
